Terms of Service for Orbit

1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of Orbit (the "Service"), operated by Accelera ("Company," "we," "us," or "our"). By creating an account or otherwise using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Description of the Service

Orbit is a community-driven platform that allows users to discover, submit, save, rate, and share AI prompts across categories including image generation, video generation, text generation, code generation, graphic design, and audio/music, along with related "reels" content.

3. Eligibility and Accounts

• You must be at least 13 years old to create an account.
• You may register using an email/password or via third-party sign-in (Google, GitHub).
• You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
• You must provide accurate information when creating an account and keep it up to date.
• We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscription Plans and Payment

4.1 Free Plan

The Free plan allows users to submit up to 5 prompts, add up to 5 reels, save up to 5 prompts, and browse all prompts and reels, at no cost.

4.2 Pro Plan

The Pro plan is offered at 100,000 Toman/month (or the then-current price displayed on our Pricing page) and includes unlimited prompt submissions, unlimited reels, and unlimited saved prompts.

4.3 Payment Processing

Pro subscriptions are currently arranged via direct contact through Telegram. If we transition to an automated payment processor, that processor's terms will also apply, and this section will be updated accordingly.

4.4 Refunds and Cancellations

Subscriptions may be cancelled at any time; cancellation takes effect at the end of the current billing period. Fees already paid are non-refundable except where required by applicable law.

4.5 Price Changes

We may change subscription pricing at any time. Changes will not affect the then-current billing cycle you have already paid for, and we will provide notice before your next renewal at a new price.

5. User Content

5.1 Ownership

You retain ownership of the prompts, descriptions, reel links, and other content you submit to Orbit ("User Content").

5.2 License Grant to Orbit

By submitting User Content, you grant Orbit a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, and distribute that content on and through the Service, for the purpose of operating and promoting Orbit.

5.3 Your Responsibilities

You represent that:

• You own or have the necessary rights to submit the User Content.
• Your User Content does not infringe any third party's intellectual property, privacy, or other rights.
• Your User Content complies with the Acceptable Use policy below.

5.4 Moderation

We reserve the right, but are not obligated, to review, edit, refuse, or remove any User Content at our sole discretion, including content that violates these Terms.

6. Acceptable Use

You agree not to:

• Submit content that is illegal, infringing, defamatory, hateful, sexually explicit, or that promotes violence or discrimination.
• Submit prompts or reels designed to generate illegal content, harass individuals, or facilitate fraud.
• Misrepresent your identity or impersonate any person or entity.
• Attempt to gain unauthorized access to the Service, other accounts, or our systems.
• Use automated means (scraping, bots) to access or extract data from the Service without our prior written consent.
• Resell or redistribute the Service, or any Pro-tier access, without authorization.

Violation of this section may result in content removal, account suspension, or termination.

7. Intellectual Property

The Orbit name, logo, design, and underlying software are the property of Accelera and are protected by applicable intellectual property laws. Except for User Content and any open-source components, nothing in these Terms grants you rights to our intellectual property.

8. Third-Party Tools and Links

Orbit references and links to third-party AI tools and platforms (including but not limited to DALL-E, Midjourney, Runway, Pika, ChatGPT, Claude, GitHub Copilot, Canva, Photoshop AI, ElevenLabs, Suno) and Instagram Reels, for informational and educational purposes. These are trademarks of their respective owners; Orbit is not affiliated with, sponsored by, or endorsed by these companies. We are not responsible for the content, policies, availability, or output of any third-party tool referenced or linked from the Service.

9. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that prompts submitted by users will produce any particular result when used with third-party AI tools, or that the Service will be uninterrupted, secure, or error-free.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Accelera and Orbit shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of or inability to use the Service. Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid us, if any, in the 12 months preceding the claim.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. You may terminate your account at any time by contacting accelerawebsite@gmail.com.

12. Changes to the Service or Terms

We may modify or discontinue the Service, in whole or in part, at any time. We may update these Terms from time to time; material changes will be communicated via the Service or by email, and continued use after such changes constitutes acceptance of the revised Terms.

13. Governing Law

These Terms shall be governed by the laws of Iran, without regard to conflict-of-law principles. Any disputes arising from these Terms or the Service shall be resolved in the courts of Iran.
